Advocates for Victims of Crime Seeking Fair Compensation.

In a recent revelation, data obtained by the Association of Personal Injury Lawyers (APIL) sheds light on the critical role of legal representation for victims of crime navigating the Criminal Injuries Compensation Scheme. The statistics show that victims who appeal initial offers through the scheme end up receiving over six times more in compensation, emphasizing the importance of seeking professional assistance.

The Data:

According to APIL's findings, in the 379 cases that reached appeal during the 2022/23 period, an average initial offer of £7,848 was made for each claim. However, upon appeal, the Criminal Injuries Compensation Authority's (CICA's) offer in these cases skyrocketed to an impressive £47,339, highlighting the significant impact of legal representation on the compensation outcome.

APIL Vice President Kim Harrison expressed concern, stating that the data "clearly suggests victims are not receiving the compensation to which they are entitled if they don’t have legal assistance." She pointed out that the CICA advises victims against appointing legal representatives but stressed that the figures reveal a stark contrast in compensation outcomes for those without legal support.

Harrison added, "Many unrepresented people, dealing with the trauma of being injured due to a crime, will not have the skills, time, or confidence to challenge a decision and will miss out on compensation they need to help them recover and put their lives back on track."

The Call for Change:

In response to a Ministry of Justice consultation on potential changes to the scope and times limits for Criminal Injuries Compensation Scheme claims, APIL called for an extension of the compensation scheme. The organization advocates for making victims of child sexual abuse eligible for damages from the CICS, recognizing the need for a broader and more inclusive approach to providing support and compensation.
